Ethics and Consent - Stuart Wallace and Benjamin Newall (DAC Beachcroft)
Ben is a Senior Associate in DAC Beachcroft's Southampton office. He specialises in defending clinical negligence claims for NHS Trusts, GPs, dentists, and private doctors. Since joining DAC Beachcroft LLP in 2013, he has handled cases involving brain injuries, amputations, delayed cancer diagnoses, and mental health claims on behalf of NHS Resolution, the Medical and Dental Defence Union and medical malpractice insurers.
Ben also conducts seminars for medical practitioners to assist with learning from claims and patient safety issues. His talks focus on helping practitioners understand the legal process, consent issues and, more recently, the advent of AI and the implications it has from a legal perspective in terms of providing healthcare.
Ben has served as interim Head of Litigation for NHS Trust clients during transitions. Previously, he represented claimants in clinical negligence cases, giving him a comprehensive perspective in this field.
Stuart is a specialist in clinical negligence litigation, with over 14 years’ experience, acting primarily on public sector claims on behalf of the NHS, including on the highest value birth, brain and spinal injury actions. He also represents private practitioners
Stuart has a particular interest in AI related issues in the healthcare space, and has spoken and written extensively on the subject, including in the Insurance Post.
